suspect has been confirmed as 24-year-old james holmes, but we now understand police and investigators on the scene of his apartment has figured out it's booby trapped. can you confirm that? >> this guy was methodical in his planning. about ten minutes ago, chief dan oates of the aurora police department said, quote, booby trapped. the third floor of this apartment unit is where this suspect lived, and on the third floor, they cannot enter that apartment because it is booby trapped. the chief said that it looks pretty sophisticated. that's his quote. the briefing was very quick, they would not answer any questions. there are fire trucks here surrounding this very generic-looking apartment complex. it's a very generic, unassuming apartment complex, but the police department dealing with an extraordinary circumstance now, a booby-trapped apartment. they won't say how it's booby trapped, but fire trucks are here with their ladders extended to the building, just in case they have to detonate things inside that apartment. >> we were watching that this morning. you mentioned the hook and lad

and the charges that are coming ahead for holmes? >> reporter: hi, thomas, how are you? we're not likely to hear that until the arraignment itself, unless one of the defense attorneys from the public defender's office gives a hint. at the arraignment, he has to offer a plea, and the only choices are guilt, not guilt, or ngi, as lawyers call it, not guilt by reason of insanity. and we'll get a sense of that and learn whether this suspect, this defendant is cooperating with attorneys. he didn't speak to the police since his arrest. he's been in solitary confinement. if they feel he's not able to assist in his own defense or understand the charges against him, they can, of course, call for a psychiatric examination. and generally the state hospital in pueblo, the state can have its psychiatrist examine him to see if that's, in fact, the case. and after the arraignment, the plea would be entered, and 60 days from there the prosecution would have to make the decision of whether or not to go for the death penalty. those decisions are down the road a bit. >> nbc's mike taibbi, thank you. prosecutors de

or not mr. holmes has a mental illness. and it's going to be a long road in order to have both of the authorities and his defense lawyers to get to the bottom of that. >> iris, the three inmates currently on colorado's death row, as we said, it's very rare for someone to get the death penalty, but two of them have been put there by the arapahoe county district attorney's office. what are the main challenges in defending a death penalty case in colorado? and is the possibility of a plea bargain an option as we move further in the legal process? >> like you said, miss chambers is the most likely to pursue the death penalty of any district attorney in the state of colorado. as rarely as it is sought in colorado, and has been over the years, but the factors that she'll look at in whether or not she's going to plea bargain the case have a lot to do with whether or not what they uncover, as his bizarre behaviors is from a mental illness or not. and the plea bargain will be life without parole. if that is a possibility. or it could be an agreement that he spend the rest of his life at
